California Lies to get Diesel Law: California Pollution Grossly Miscalculated

California "grossly miscalculated" pollution levels by 340%, to bring about their "landmark Diesel Law." Does any greenie have an ounce of truth in him/her?

When the law was issued in, it had numerous standards to meet, and replacing all engines older than the 2010 models was one of them, a devastating swipe at business.

The estimate was a key part in the creation of a regulation adopted by the Air Resources Board in 2007, a rule that forces businesses to cut diesel emissions by replacing or making costly upgrades to heavy-duty, diesel-fueled off-road vehicles used in construction and other industries.

The staff of the powerful and widely respected Air Resources Board said the overestimate is largely due to the board calculating emissions before the economy slumped, which halted the use of many of the 150,000 diesel-exhaust-spewing vehicles in California. 

Now, do you believe that? Right! Neither do I.

Independent researchers, however, found huge overestimates in the air board's work on diesel emissions and attributed the flawed work to a faulty method of calculation - not the economic downturn.

So now, maybe, the requirement to start the "landmark" Diesel Law will be put off until 2014.

It would be a major scaling back of the rule if the air board approves it in a vote scheduled for December.

The California governor's race is all over this. Meg Whitman has promised to suspend the law for "at least a year." Moonbeam Jerry Brown is still a supporter.

California voters, meanwhile, will vote on Proposition 23, a November initiative to suspend AB32 until the unemployment rate - now at 12.4 percent in California - falls to 5.5 percent or less for a year.

You and I both know that may be one hell of a very long time.

The combination of limp hiring by businesses and more governments layoffs expected means unemployment could rise to 10 percent again this year or next. When Obama took office in January 2009, the unemployment rate was 7.7 percent. Source.

This article quotes "most economists" saying it will likely take, at least, until 2015 for unemployment to reach a "more normal 5.5%."

Taxpayers Money Hypes EPA and Obamas Right to Make Regulations

Regulations.gov is having a contest and paying a reward with taxpayer monies, but that is the least of the irony. The administration wants you to make a video to hype Obama's right, and the right of his regime, to make regulations. A video titled Rulemaking Matters! will pay the winner $2500 to tell America why government regulations are a good and necessary thing.

To ease your mind, I feel certain the $2500 is offered responsibly, and will only be paid to a winner who actually pays federal taxes - don't you think?

Remember when Congress refused to create law that declared carbon dioxide a pollutant, and the EPA just declared it so, with Obama's blessing. It didn't become law, it became a regulation. Of the declaration, The Heritage Foundation said "Cap and trade, a climate treaty and EPA regulations are the three ugly step-sisters of climate policy. Since ClimateGate, we now know, without a doubt, what we suspected all along, that human-induced climate change is a lie.

You'll hear in this instructional video that Congress should make the laws (yes, they should, as well as deciding not to make a law - certainly just as valid), but the video says that the "regulators will then decide how the law works. If you watch Glenn Beck, you know he says Cass Sunstein, The Regulatory Czar, is the most dangerous man in American because he can regulate about anything and everything, as he pleases.

So, as MensNewsDaily says, we will have a plethora of "Rulemaking Matters" videos posted to YouTube  that don't have a chance of winning, but will be propaganda. The Left-wing blogs will have enough propaganda and homage to Cass Sunstein and Climate Change to get them to Fall,  and we will all be clear about  just how necessary regulations are to the happiness and well being of Barack Obama et al.

States Sue EPA to Restrain Control of Greenhouse Gas Emissions

Fifteen states are suing the EPA to stop their roll-out of environmental regulations that as yet, are an unsubstantiated need. Remember that Congress failed to pass a law to control greenhouse gases, so Obama handed over control to the EPA under the Clean Air Act.

The states claim that the EPA is using data from the disgraced United Nations Intergovernmental Panel on Climate Change (IPCC) and known these days as the ClimateGate Panel. The plaintiffs want the data verified - and hopefully, they will accept nothing from anyone considered a climate scientist over the past 15 years.

At least 15 states including Florida, Indiana, South Carolina have filed petitions in Washington, D.C., and have joined petitions filed earlier by Virginia, Texas and Alabama.

The Obama administration has long said it would attack greenhouse gas emissions with EPA regulation if Congress failed to pass a climate bill.

The EPA is set to issue regulations later this month that would require autos and light trucks to increase energy efficiency. That would trigger rules on large emitters like power plants requiring them to get permits showing they are using the best technology available to reduce emissions [ID:nN17158103].

The state petitions call for the EPA to reopen hearings on the so-called "endangerment finding" the agency issued last year declaring the emissions dangerous to people.

"If EPA doesn't reopen the hearings we will move forward to try to stop them from regulating greenhouse gases," said Brian Gottstein, an assistant to Virginia's Attorney General Kenneth Cuccinelli.

Graphic Sources: Global Warming Petition Project and Here's My Thing The EPA has cleared the process for new coal-fired power plants by ruling invalid a requirement that greenhouse gases be considered pollutants. In otherwords, when an application for a license is under consideration, officials cannot require a new plant to regulate carbon dioxide. Stephen L. Johnson, EPA administrator, attempting to clear up any confusion about "what can be considered a pollutant to be regulated," said:

"The current concerns over global climate change should not drive E.P.A. into adopting an unworkable policy of requiring emission controls” in these cases,...

Environmental groups have argued that the current requirement to "monitor" carbon dioxide is the same as regulating emissions, and therefore, these emissions must be a part of the approval or disapproval of licenses. Johnson ruled that "simple monitoring" is not the same as "regulation."

Vickie Patton, deputy general counsel of the Environmental Defense Fund, estimated that as much as 8,000 megawatts of new coal-fired power plants could win swifter approval as a result of the ruling.

Bruce Nilles, director of the Sierra Club's "anticoal campaign:"

There are a bunch that they are going to argue now don’t have to consider carbon dioxide, and which will be beyond the reach of the incoming Obama administration,...

In the meantime, outside the panels and the courts, the battles still rage. This from Investors Business Daily:

If the issues weren't so serious and the ramifications so profound, I would have to laugh at it," said David Deming, a geology professor at the University of Oklahoma. "The mean global temperature, at least measured by satellite, is the same as it was in the year 1980. In the last couple of years, sea level has stopped rising, hurricane and cyclone activity in the Northern Hemisphere is at a 24-year low and sea ice globally is also the same as it was in 1980." Speaking of rising sea levels, is Al Gore smarter than a fourth-grader? James O'Brien, emeritus professor at Florida State University who studies climate variability and the oceans, thinks not. "When the Arctic Ocean ice melts, it never raises sea level because floating ice is floating ice, because it's displacing water," he points out. "When the ice melts, sea level actually goes down. I call it a fourth-grade science experiment: Take a glass, put some ice in it, put water in it, mark level where water is. . . . After the ice melts, the sea level didn't go up in your glass of water. It's called the Archimedes principle." Global temperatures stopped rising after 1998 and have plummeted in the last two years by more than 0.5 degrees Celsius. The 2007-08 temperature drop was not predicted by global climate models. It was predictable by a decline in sunspot activity since 2000 and by a cyclical ocean-current phenomenon known as the Pacific Decadal Oscillation. On CNN's "Lou Dobbs Tonight" recently, Jay Lehr, a senior fellow and science director at the Heartland Institute, was asked by the host what he considered the dominant influence on Earth's climate. "Well, clearly, Lou, it is the sun," Lehr answered, adding that "if we go back in really recorded human history; in the 13th century, we were probably seven degrees Fahrenheit warmer than we are now." Lehr considers global cooling to be the real threat, part of a natural pattern as we continue coming out of a period known as the Little Ice Age. "If we go back to the Revolutionary War, 300 years ago," he said, "it was very, very cold. We've been warming out of that cold spell from the Revolutionary War period. And now we're back into a cooling cycle." The Associated Press claims that the 10 warmest years on record have occurred since Bill Clinton's second inaugural. But after it was discovered that NASA's James Hansen, Gore's chief scientific ally, had been fudging the numbers, the agency was forced to correct its data. The 10 warmest years turn out to be, in descending order: 1934, 1998, 1921, 2006, 1931, 1999, 1953, 1990, 1938 and 1939. If there's a trend there, we don't see it. So is global warming man-made and an imminent danger? As the snow falls in Vegas, don't bet on it.

Nevermind all that. The Obama administration's newly announced EPA Administrator, Lisa Jackson is expected to be "grateful" for this latest EPA ruling. Jeff Homstead, a former EPA official says the ruling ensures the Obama administration has "increased freedom to make ts decisions on the status of carbon dioxide." After January 20th, we'll see just how fast Obama and Company can turn this around.
