Umar Farouk Abdulmutallab
If Umar Farouk Abdulmutallab's actions on Christmas Day are an act of terror, and sponsored by al-Qaeda, as our President asserts, why is he not a prisoner of war? Senator Joe Lieberman is says the law of war applies, Abdulmutallab should be held in a "military brig," and should have been questioned by military and intelligence personnel now, and in the beginning. Rep. Peter King is calling for a military tribunal and says this man should now have the right to a civilian attorney.
By the way, this Muslim man with the very rich father asked for an attorney but said he could not pay for one. You and I will pay for his indefensible defense.
In October, Obama signed into law legislation that affirms a "sense of Congress" which asserts the preferred forum for the tril of "alien unprivileged enemy belligerants is a trial by military commission." What it is that distinguished Abdulmutallab outside the realm of an "alien unprivileged enemy belligerant?" There is, of course, nothing to distinguish him as otherwise.
If Abdulmutallab were an "alien unprivileged enemy belligerant" he would not be read his Miranda rights. Was he read his Miranda rights? Most certainly. This is the one distinguishing condition of the new legislation - no mirandizing.
Note that the first responsibility of a Military court is the protection of national security, but the first responsibility of a civil Federal court is to protect the rights of the defendant. John Brennan, Obama's top security adviser said yesterday that it is not a problem that Abdulmutallab has all the privileges of an American citizen in court, BECAUSE WE CAN OFFER HIM A PLEA BARGAIN, to get him to talk. Is this America? I ask you...is this America?

John Brennan, President Obama's top counterterrorism expert, justified treating the underwear bomber as a criminal with all the rights of a U.S. citizen, rather than an enemy combatant with no right to remain silent or demand a lawyer or a civil trial, by arguing that the government can offer him a plea bargain in exchange for his cooperation.
In other words, just like we give deals to drug smugglers or mobsters to give up information on bigger fish in their criminal enterprises, we can do the same with Abdulmutallab.
Had Abdulmutallab been designated as an enemy combatant from the start, we would not have had to offer him anything at all in exchange for the information he possesses. He could have been interrogated immediately by professionals without Miranda warnings, without a lawyer, and against his will.This sets the scene for Abdulmutallab to be set free in exchange for information. It could happen. To think otherwise is foolish.
Tell me, how many in Holder's Department of Justice are on the battlefield and waging a war against terrorism? The answer is zero. Only U.S. military fights wars against foreign combatants, and they should be the only avenue to meet these "belligerents" in court.
I've been reading some lesser known press. Some of these reports are interesting and I think worthy of printing. Are they facts? Don't know. We'll see. The following are snippets, and I cannot vouch for any of it.
1) Umar Farouk Abdulmutallab's father, Alhaji Umar Mutallab may not be such a gentle and peaceful Muslim dad. Some believe that he was a very strict Muslim, and that his son was raised strictly. Some see American press erring in proclaiming the father's visit with the CIA as less a warning of harm to the U.S., and more an attempt to garner help in finding the son.

Again, the fact that his father must have sewn the seed of Islamic radicalization is not being articulated here: the father felt strongly about Islam that he decided the banking system was not good enough, was not practicing Islamic banking laws, that he pushed hard to found the first Islamic bank in Nigeria....and the same source questions the family money:
Again, we have to caution about hailing Alhaji Umar Mutallab as an hero, as some in the American media are trying to do for seeking help from the American embassy in finding his son and his expression of concern about his son's radical Islamic turn.According to BlackStarNews:
What is being focused on is how wealthy the family is, but the question of how he accumulated so much money without evidence of how he made that money should give pause to those who are trying to extol his virtues.
1) Abdulmutallab completed his Yemen Islamic studies in September 2009 and classmates "saw him off at the airport," but Abdulmutallab did not leave Yemen.
It is speculated that Mr. Umar Farouk Abdulmutallab left Yemen around the 13th of December, for Ethiopia. The Ethiopian government has not said how long he stayed in Ethiopia. His next destination was Ghana.Yesterday we heard Obama's Deputy Security Adviser, John Brennan tell CNN's Gloria Borger that paying cash for a ticket in Africa is the way it's done - it's done all the time because of corruption, but KLM is not an African company, and major airlines are not considered corrupt in their actions. He was allowed to pay cash and refused to give contact information.
It was in Ghana that the KLM office there in Accra sold him a one-way ticket for $2,831 in cash. This is where the whole thing starts to muddy up. According to all accounts, Mr. Umar Farouk Abdulmutallab not only paid for his one-way ticket in cash, but refused to provide a contact address.
2) BlackStarNews confirms that Abdulmutallab had a Nigerian passport when the checked in at KLM.
3) According to the Director General of Nigerian Civil Aviation Authority, Abdulmutallab originall purchased a one-way ticket to Detroit, via Amsterdam, with no contact address or telephone number at KLM in Accra. That ticket was canceled and re-issued as a round-trip ticket, returning to Lagos, Nigeria. The return trip was scheduled for January 8, 2010. His passport was scanned at check-in. His US visa was scanned, and the "passenger information system returned no objection." He was allotted seat number 20B on the Lagos - Amsterdam leg, and seat 19A on the Amsterdam - Detroit leg.
"The passenger possessed a Nigerian machine readable passport issued Sept 15, 2005 to expire Sept 14, 2010 with passport number A3921640. His multiple entry US visa was issued in London, UK, on June 16, 2008 to expire June 2010.""Thereafter, he passed through aviation security comprising of walk- through metal detector and baggage X-ray screening machine. He proceeded to the boarding gate where he went through secondary screening as confirmed by KLM officials. At the closure of the departure, passenger was confirmed on board, his name was on the post manifest under the serial number 2."
AllAfrica.com says that the father's wife is of Yemen descent, but cannot confirm that the Yemen women is Umar Farouk Abdulmutallab's mother.
Source WSJ: It is believed that Abdulmutallab spent 13 days in Accra, Ghana. He had numerous options for flying to the U.S. from Ghana, but instead flew back to Lagos.
...he boarded Virgin Nigeria flight 804 from Accra to Lagos on December 24, which departed at 5:06 p.m. "He filled the immigration forms on the flight," he said. "I have all those on the form before me so I know he was on the flight." He said the Ghanaian officials were trying to discern why Mr. Abdulmutallab chose to return to Lagos rather than fly to the U.S. from Ghana.
"We have numerous flights to Amsterdam from here," said Mr. Okudzeto-Ablakwa. "There's even a direct flight to the USA from Delta Airlines. This has remained baffling, why he went to Lagos before beginning a new journey." Mr. Okudzeto-Ablakwa said that Ghanaian officials had tightened security since the incident and plan to install full-body scanners at Kotoka International Airport in Accra.Source: BlackStarNews (linked above): He left Ghana on the 24th of December and flew to Lagos, Nigeria. He arrived in Lagos at 8:08 p.m. and less than 40 minutes later, he checked in for the Amsterdam-Detroit flight. Except for the time between arriving and departing, Abdulmutallab had not been in his home country of Nigeria for 5 years.
