Jeff Sessions: America Will Not Forgive this Senate for Confirming Kagan

Minutes before the vote to confirm Elena Kagan, Senator Jeff Sessions said "The American people will not easily forgive this Senate if we confirm Ms. Kagan to the Supreme Court." Think about waking up on November 3rd, 2010 without the significant change needed to keep another Elena Kagan off the Supreme Court.

Those voting for Kagan wonder what all the fuss is about, and try to ignore the fact that 37 members of the Senate voted against her. Only three additional votes were needed to filibuster, yet five Republicans voted yea for a nominee: who has never been a judge; they knew manipulated abortion facts, and turned them into lies which overturned an abortion ban in Nebraska; who at Harvard refused Military recruiters on the grounds, and welcomed Islamic Shariah financing, which funds terrorism, into the law school along with three Saudi-funded studies of Shariah.

Republican Senators voting for Kagan were Susan Collins and Olympia Snowe (Maine), Lindsey Graham (NC), Dick Lugar (IN), and unbelievably Judd Gregg of New Hampshire. Senator Ben Nelson (NE) is the lone Democrat voting against Elena Kagan.

By modern standards, Justice Kagan's 63 confirmation votes isn't exactly an overwhelming display of support. Of the Supreme Court's nine current justices, 63 ranks fairly low -- Stevens (98), Kennedy (97), Scalia (98), Ginsburg (96), Breyer (87), Roberts (78), Sotomayor (68) had more, while only Thomas (52) and Alito (58) had fewer.

Today we talk about fighting for the America that we know and have known. If Obama is allowed to make another appointment, that America is gone. Justice Anthony Kennedy says he will put-off his retirement until after the 2012 presidential election. Hallelujah for that, but we still cannot assure through this court appointed for a lifetime that the Constitution will guide the way our government works. We must understand that the Supreme Court is the most important issue we face today. Senator Sessions' prediction that this appointment will not be forgiven is insightful.

Lindsey Graham Supports Elena Kagan Doctoring Medical Opinions on Partial Birth Abortion

Senator Lindsey Graham (R-SC) was the lone Republican vote on the Senate Judiciary Committee to allow Elena Kagan to go forward in her confirmation hearings. Graham said Kagan would not be "his choice," but said he thought Obama "chose wisely." Now, understand that this woman actually convinced a task force of physicians to falsify their own statement which would be used to decide on the legality of partial birth abortions at the Supreme Court. How does Senator Graham think his vote is appropriate?

Because of this falsified statement, credited to a task force referred to as a "select panel" of the American College of Obstetricians and Gynecologists (ACOG), the U.S. Supreme Court struck down Nebraska's partial-birth abortion ban in 2000.

The falsified statement basically said, in the name of physicians, the partial-birth abortion "may be the best or most appropriate procedure in a particular circumstance to save the life or preserve the health of a woman," which is not what the physicians said. Kagan replaced a medical judgement with a political agenda.

The ACOG said exactly the opposite. Unborn children have died because Elena Kagan lied:

The task force's initial draft statement did not include the statement that the controversial abortion procedure "might be" the best method "in a particular circumstance." 

Instead, it said that the select ACOG panel "could identify no circumstances under which this procedure...would be the only option to save the life or preserve the health of the woman."

ACOG, although said to be apolitical, gave their statement to the Clinton White House, where Elena Kagan lurked:

Miss Kagan, then a deputy assistant to the president for domestic policy, already knew ACOG’s stance as a result of a July 1996 meeting at the White House, at which ACOG representatives told administration officials — according to a Kagan memorandum [PDF] — that “in the vast majority of cases, selection of the partial birth procedure is not necessary to avert serious adverse consequences to a woman’s health.”

Kagan told the White House this statement "would be a disaster:"

Her notes, produced by the White House to the Senate Judiciary Committee, show that she herself drafted the critical language hedging ACOG’s position. On a document [PDF] captioned “Suggested Options” — which she apparently faxed to the legislative director at ACOG — Kagan proposed that ACOG include the following language: “An intact D&X [the medical term for the procedure], however, may be the best or most appropriate procedure in a particular circumstance to save the life or preserve the health of a woman.

ACOG did exactly as she asked and added her statement, exactly as she wrote it, to their own. The statement went to the Supreme Court and her part in it was not disclosed to the Supreme Court Justices.

Slate writer William Saletan said Kagan was "only doing her job," but he did slam ACOG for so willingly and silently being a White House tool.

In Committee hearings, the note she wrote in her hand was identified by Kagan. She said she was "clarifying a position." How vile does one have to be to change medical science to allow a late term abortion, and how incredibly evil does Congress have to be to put this woman on the Supreme Court?

Today brings some news, for which I am grateful, if it is true. Justice Anthony Kennedy says he will not step down from the Supreme Court until after the 2012 elections, possibly preserving the fabric of America.

Justice Kennedy, appointed to SCOTUS by President Ronald Reagan, is the swing vote that often, but not always, preserves a conservative voice on the Nation's highest Court. According to the New York Daily News, Kennedy has told family and friends he will stay on the court until after the 2012 presidential election.

From the beginning of Obama's presidential campaign, it was obvious if he was elected, the most dangerous thing about the man (other than breaking us financially) would be his opportunity to load the Supreme Court with radical judges like Sonia Sotomayor, a member of LaRaza, and Elena Kagan who lied to make abortion more palatable to SCOTUS, and thinks the U.S. Constitution is a "living breathing" document, just gasping for a Progressive "fix." Kagan will no doubt be seated. If Kennedy, now 74 years young, doesn't leave the bench during The Time of Obama, we have the opportunity to preserve our Constitution and our Republic. Thank you Justice Kennedy!

Kagan Stalls on Commerce Clause

Senator Tom Coburn (R-OK) asks Supreme Court nominee, Elena Kagan, if a law saying Americans had to eat three fruits and three vegetables every day is supported by the Commerce Clause in the U.S. Constitution. Coburn's question is analogous to the healthcare law passed, and supposedly made legal by the Commerce Clause. See the video below.

Kagan would not answer the real question. She understood that Coburn was asking about healthcare legislation, but said passing a law requiring everyone to eat three fruits and vegetables a day would be a "dumb law."  Her answer? She thinks:

 "courts would be wrong to strike down laws that are senseless just because they are senseless."

Many do not believe the healthcare law will pass Supreme Court scrutiny, because it allows the government to require everyone in the U.S. to buy a produce (health insurance), and if they do not, they will be penalized by the government. In other words, citizens will be penalized for DOING NOTHING.

Jeff Sessions Opening Remarks at Kagan Hearing Video

Senator Jeff Sessions (R-AL) listed an astounding number of violations of Federal law committed by Obama's Supreme Court nominee, Elena Kagan. I am at a loss to understand how Democrats will find this woman, who has spent her professional life in activism, with complete disdain for the U.S. Constitution, qualified for this life-time position. The fact that she will end up on the Supreme Court and my children and grandchildren will live with her lack of integrity and contempt for the Rule of Law is heartbreaking. See the video below.

Here are a few of Sessions comments (paraphrased):

Kagan has less real legal experience of any nominee in at least 50 years.

Not only has she not been a judge, she has barely practiced law, and not with the intensity and duration that I think real legal understanding occurs.

Kagan has never tried a case before a jury

She argued her first appellate case just 9 months ago. There is no substitute of being in the harness of the law, handling real cases over a period of law.

Kagan has spent her career in policy and politics, mixed with law.

Her college thesis, Socialism in New York, bemoan socialism's demise.

Her Master's thesis noted the activist tendencies of the Earl Warren court - but said it could have done a better job justifying their activism.

Kagan left law for 5 years for politics.

Kagan was central figure in the White House Clinton-Gore effort to restrict gun rights.

She was the point person for the Clinton Administration effort to block Congressional restriction on partial birth abortions - the key person to convince Clinton to change his mind from supporting restrictions to opposing legislation that would ban it.

While at Harvarvd as the Dean, she reversed existing policy, and kicked military out of recruiting offices in violation of federal law. She punished our Military and demeaned our soldiers as they fought in two wars overseas.

Kagan joined 3 other law school Deans to write a letter in response to Senator Grahams legislation to establish procedures to determine who was an enemy combatant in the war on terror. She compared this legislation, which passed 84 to 14 as fundamentally the same as the lawless actions of a dictatorship. Gr

As Solicitor General for 1 year, her short tenure was not without controversy. In her first appellate argument that speech and press guarantees of First Amendment would allow Federal Gov't to ban publications and pamphlets discussing political issues before an election. As Solicitor General, Kagan approved filing of a brief  to SCOTUS asking that it strike down provisions of the legal Arizona Workers Act which suspends or revokes the businesses licenses of corporations which knowingly hire illegal aliens, even though Federal law expressly prohibits such hiring. She did this even after the liberal 9th Circuit upheld the law.

There is much more. I hope you will listen to the video. If you believe Kagan should be confirmed, please ask yourself why you want a judge who will attempt to change, at least the First and Second Amendments, refuse to define an enemy combatant and abort late-term babies?

Elena Kagen Memos in Clinton White House to be Held by Obama Admin

No surprise here. The Obama administration believes they can withhold evidence at any time. No different in the confirmation of a Supreme Court nominee - always one of the most important events in the governing of our Republic. This time, the Judiciary Committee is requesting the memos of Supreme Court nominee, Elena Kagen, written while serving in the Clinton White House.

Obama and Bill are getting together to decide which documents to block. Obama's personal counsel, Robert Bauer, suggested the Judiciary Committee request the documents under the Freedom of Information Act (FOIA). Republicans say that is "bizarre:"

...because...the Judiciary Committee's request is privileged, unlike a FOIA request. In other words, while Clinton can block the release of documents requested under FOIA, he can't block documents requested by the Committee....

Republicans also believe that between Bauer's statements and those of the White House, the plan might be to dump "hundreds of thousands of pages of documents as late as June 27, the day before the hearing...." Republicans, as the minority party, cannot reschedule the hearings, and apparently Democrats don't care what Kagen wrote, believed or believes.

A final issue of dispute regards whether Clinton retains authority to assert executive privilege over the documents. Under Executive Order 13489, enacted by Obama, only Obama can asset executive privilege to block the documents.

Kagen's paper-trail is almost non-existent, so the Clinton documents might lend the only insight into the beliefs of Elena Kagen.

Oh Dang! Specter may tack Right

Defeated Senator Arlen Specter (D-PA), who won't be coming back to the Senate after this session is hinting that he may begin voting more like a Republican than a Democrat:

...several longtime friends and associates tell The Daily Beast that without a primary challenge to pressure him, the veteran senator - a famously prickly character whose temper has earned him the nickname "Snarlin' Arlen" - may shift to the right

The big question seems to be, will Specter vote for Elena Kagan's confirmation? Of course he will. Duh!

Jon Kyle on Filibuster of Obama SCOTUS Nominee: GOP Filibuster of SCOTUS Nominee?

Justice John Paul Stevens has sent signals that he will be retiring soon. He hired only one law clerk, when the usual number is four. Both sides are gearing up for a fight for the future of America. Senator Jon Kyl (R-AZ) was on FOXNews Sunday today with Chris Wallace. Wallace asked Kyl if the GOP will filibuster the next Supreme Court of the United States (SCOTUS) nominee. Kyl responded that it would depend on the nominee and his/her view of law. (see the video below)

Senator Kyl said if the nominee was not overly ideological, Republicans might vote against the nominee, but would likely not filibuster, going back to the Gang of 14's rule that you do not filibuster unless there are extraordinary circumstances.

[Kyl] I want a judge who will read the law and declare it in each case that comes before him or her as it should be — in other words, don’t have somebody coming in with preconceived attitudes — I’m going to be tough on the executive, or, I’m going to be for the little guy, or whatever their preconceived attitudes are. We’ve had too much of that. [...]

I think the president will nominate a qualified person. I hope, however, he does not nominate an overly ideological person. That will be the test. And if he doesn’t nominate someone who is overly ideological, I don’t think — you may see Republicans voting against the nominee, but I don’t think you’ll see them engage in a filibuster.

KYL: I would prefer to go back to the situation where it is not done by either party, but the Democrats won that fight. They filibustered Miguel Estrada. He never got on the court. Seven other circuit nominees. So what we need to do is, I think, apply the rule that the Gang of 14 game up with a couple years ago that you don’t filibuster except in extraordinary circumstances, and I’m willing to live by that general rule. 

Kyl gave a succinct answer to why a filibuster might be appropriate, or not, and it is all about ideology. He makes Senator Arlen Specter look like the Liberal he is. This is a good video.

Lael Brainard Barack Obama: Lael Brainard Tax Problems: Lael Brainard Treasury Nominee Tax Problems

Here's another one - the fifth of Obama's nominees with tax problems. Lael Brainard is Obama's nominee for undersecretary of the Treasury for international affairs...and she didn't pay taxes in three tax years.

Brainard "was late" paying real estate taxes in 2005, 2006 and 2007, according NewsMax. The Senate Finance Committee is also questioning a deduction she took for running an office out of her home, on her 2008 return. She has since adjusted that deduction with the IRS.

Brainard comes from the liberal Brookings Institution, where she helped start the Global Economy and Development program. She is a veteran of the Clinton administration, where she worked as the deputy director of the National Economic Council under Gene Sperling. She also advised Obama during his 2008 presidential campaign.

Brainard is married to Kurt Campbell, President Obama's assistant secretary of state for East Asia and Pacific Affairs. Is there anyone in the Obama adminstration without a tax problem -  who pays taxes on time and correctly - like the rest of us out here?

Chappaquiddick Joke on Ted Kennedy

ChicagoRay found this video. Ed Klein tells the story of Chappaquiddick being one of Ted Kennedy's favorite jokes. Klein is a former Editor of The New York Times Magazine and currently the foreign editor of Newsweek. He is releasing a new book on Ted Kennedy, and the question is, who isn't? If this is true, the joke is really on Ted Kennedy. He may be lionized today, but surely those hearing the "Chappaquiddick" jokes, had to wonder what kind of a sick joke Ted Kennedy was.

As he has been memorialized today, it is obvious that he was beloved by his family, that he stepped up for all the nieces and nephews who were fatherless, that his own children loved him dearly, and that he knew how to get done what he wanted to get done in the halls of the U.S. Senate.

What I remember about Ted Kennedy is the Kennedy-McCain Amnesty Bill - one of the most devastating Bills to ever hit Capitol Hill. I won't forgive Kennedy or McCain for that one. I won't forget what he did to Judge Robert Bork. It was cruel and contemptible and it all lies. For those who want to see as his pompous tirade about the Judge as merely political rhetoric, your political world is much different than mine. I didn't know much about Robert Bork at the time, as most Americans didn't, but Kennedy's comments were uncalled for and only a black heart could stand in the Senate and rip a good man in this way:

Robert Bork’s America is a land in which women would be forced into back-alley abortions, blacks would sit at segregated lunch counters, rogue police could break down citizens’ doors in midnight raids, schoolchildren could not be taught about evolution, writers and artists could be censored at the whim of the Government, and the doors of the Federal courts would be shut on the fingers of millions of citizens for whom the judiciary is — and is often the only — protector of the individual rights that are the heart of our democracy… President Reagan is still our president. But he should not be able to reach out from the muck of Irangate, reach into the muck of Watergate and impose his reactionary vision of the Constitution on the Supreme Court and the next generation of Americans. No justice would be better than this injustice.

This was not acceptable for the U.S. Senate, and he should have been excoriated by his peers, but he he was not - it's just politics. And may we all be reminded that Ted Kennedy wanted no part of windmills or oil rigs off his Hyannis Port shoreline, but he didn't mind if they were in your backyard.

I have no way to know whether Ted Kennedy had real remorse for the death of Mary Jo Kopechne, but I feel he did. Who would not, but you can read what some of the locals had to say, as well as some astonishing, odd and unusual details of what really happened here. Ted Kennedy's real legacy is proof that we should make it unlawful to be a career Senator or U.S. Representative.

In Congressional testimony, Supreme Court nominee Sonia Sotomayer claimed she couldn't think of a self-defense case having come before the Supreme Court, adding, "I could be wrong, but I can't think of one."

Conservatives and Liberals agree that Sonia Sotomayor hid her liberality while testifying at Congress about her views, and how those views will influence her decisions if she is confirmed for the U.S. Supreme Court. Ignoring Sotomayor's La Raza membership, an extremist organization known as the "Latino answer to the KKK," and many other controversial opinions, papers and speechs, some Conservatives will cast a vote for her. Liberals will all vote for her, but activists are grousing that she has let down the cause, abandonded her judicial captial, and betrayed minorities by donning her Conservative hat and keeping her cool. Liberals are flummoxed that this week's testimony is not the Sonia they know and love, ...the same Sonia that will deny a White man his right to have a reverse discrimination case heard, the Sonia that holds membership in La Raza,

La Raza was condemned in 2007 by former U.S. Rep. Charles Norwood, R-Ga., as a radical “pro-illegal immigration lobbying organization that supports racist groups calling for the secession of the western United States as a Hispanic-only homeland.”

Norwood urged La Raza to renounce its support of the Movimiento Estudiantil Chicano de Aztlan – which sees “the Race” as part of an ethnic group that one day will reclaim Aztlan, the mythical birthplace of the Aztecs. In Chicano folklore, Aztlan includes California, Arizona, Nevada, New Mexico and parts of Colorado and Texas.

...the same Sonia that, speaking as a member of La Raza, said "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion as a judge than a white male who hasn’t lived that life,” and then repeated it another 6 times, the same Sonia that supports "the Latino answer to KKK," :

Miguel Perez, a La Raza spokesman at Cal State-Northridge, has been quoted as saying: “The ultimate ideology is the liberation of Aztlan. Communism would be closest [to it]. Once Aztlan is established, ethnic cleansing would commence: Non-Chicanos would have to be expelled — opposition groups would be quashed because you have to keep power.”

...the same Sonia who has had 60% of her rulings overturned by the Supreme Court,

 ...the same Sonia who in January 2009 ruled that States do not have to abide by the Second Amendment. In other words, if a State decides that residents do not have the right to keep and bear arms, then Sonia thinks that decision is Constitutional. In Maloney v. Cuomo, she signed the opinion stating a that the Second Amendment does not protect individuals from having Second Amendment rights.

 ...the same Sonia who holds for abortions at any stage of pregnancy even if the mother's life is not endangered, the same Sonia who ruled in favor of a Muslim inmate's right to have a "holiday feast" (which had been denied him because the particular holiday was not a mandatory holiday in Islam) on the grounds that it was "subjectively" important to him, regardless that it was not important to Islam. ...the same Sonia who opined in a dissenting opinion that minority felons should have the right to vote, based on past discriminations,

 ...the same Sonia who voted for the courts of other Nations to have a say when one parent removes a child from the country without the other parent's consent - in other words, you, the parent, might be subject to the opinion of a court in another land where your spouse absconded with your child without your permission.

 Still yet, some Republican liberals plan to vote to confirm Sonia Sotomayor to the Supreme Court. The names are no surprise. We learned some time ago we cannot count on Senator Richard Lugar (R-IN), Senator Olympia Snow (R-MAINE) and now Senator Mel Martinez, a Republican Hispanic senator from Florida who is retiring in 2010. 13. “The Race” vehemently opposes cooperative immigration enforcement efforts between local, state, and federal authorities.

Former “Race” president Raul Yzaguirre, Hillary Clinton’s Hispanic outreach adviser, said this: “U.S. English is to Hispanics as the Ku Klux Klan is to blacks.” He was referring to U.S. English, the nation’s oldest, largest citizens’ action group dedicated to preserving the unifying role of the English language in the United States. “The Race” also pioneered Orwellian open-borders Newspeak and advised the Mexican government on how to lobby for illegal alien amnesty while avoiding the terms “illegal” and “amnesty.” 

5. “The Race” gives mainstream cover to a poisonous subset of ideological satellites, led by Movimiento Estudiantil Chicano de Aztlan, or Chicano Student Movement of Aztlan (MEChA). The late GOP Rep. Charlie Norwood rightly characterized the organization as “a radical racist group . . . one of the most anti-American groups in the country, which has permeated U.S. campuses since the 1960s, and continues its push to carve a racist nation out of the American West.” 

4. “The Race” is currently leading a smear campaign against staunch immigration-enforcement leaders and has called for TV and cable news networks to keep immigration enforcement proponents off the airwaves — in addition to pushing for Fairness Doctrine policies to shut up their foes. The New York Times reported that current “Race” president Janet Murguia believes “hate speech” should “not be tolerated, even if such censorship were a violation of First Amendment rights.” 

3. “The Race” sponsors militant ethnic nationalist charter schools subsidized by your public tax dollars (at least $8 million in federal education grants). The schools include Aztlan Academy in Tucson, Ariz., the Mexicayotl Academy in Nogales, Ariz., Academia Cesar Chavez Charter School in St. Paul, Minn., and La Academia Semillas del Pueblo in Los Angeles, whose principal inveighed: “We don’t want to drink from a White water fountain, we have our own wells and our natural reservoirs and our way of collecting rain in our aqueducts. We don’t need a White water fountain . . . ultimately the White way, the American way, the neo liberal, capitalist way of life will eventually lead to our own destruction.”

Protesting Sotomayor: Do it Now, Do it Again, Start All Over and Do it Some More

If you are concerned about the successful confirmation of Sonia Sotomayor to the U.S. Supreme Court, then I know you are calling, emailing, faxing and calling some more. But in the event you are too busy to think about how to express the extent of your feelings about this woman making it totarget="_blank">blogger friend provided the following for your convenience, and my friend received it from her friend. I know, more information than you want to know, but I want to give credit where credit is due.

While we may think Sotomayor's succession cannot be stopped, let us not stop our opinions and protests until this segment of showtime is over. No matter how you think your Senator will vote, call, email, fax and call again anyway. Use the following as talking points, or a letter or a fax, and if you are Republican, don't forget to include these words in your communications:

Senator, if you think that women and Hispanics will not vote for you in your next election, because you did not vote for a Hispanic woman for the Supreme Court, think again. They have no record of voting for you at any time, so vote NO on the confirmation of Sonia Sotomayor.

Dear [Senator] I am writing to urge you to join with me in rejecting Judge Sonia Sotomayor for the United States Supreme Court. The essential issue with this nominee is whether she will perform her duties to the Constitution of the United States fairly, impartially, and within the context of the supreme law of our land. [Senator] , there is no doubt that Sonia Sotomayor is a judge, but she is not a fair judge, nor has she demonstrated impartiality on the bench, nor do her previous statements reflect a willingness to fulfill her important task of interpreting the law. I may not be qualified to evaluate her judicial qualities, but I can certainly surmise that when 71.4% of her cases referred to the Supreme Court were overturned, we may justifiably question her judicial competence. Further, [Senator], the public is already aware of statements she made with respect to making policy at the appellate court level. She may certainly deny this statement now, but there is no question that she said it, and even worse was the facial expression and tone of her voice when she made that statement. She is, in my view, far too arrogant to assume the awesome responsibilities of a Justice on the highest court in our nation. And now finally, [Senator], let me suggest to you that a decision whether or not to confirm Sonia Sotomayor must be determined based on our country’s best interests. It is my determination as a citizen of these United States that no elected official who cares about his or her country, its people, or its hallowed traditions, can possibly vote to confirm Sonia Sotomayor. Patrick Leahy, Sotomayor Misquote: Leahy Misrepresents Sotomayor

Senator Patrick Leahy gave Sonia Sotomayor an opportunity to explain one of her now infamous remarks, and in doing so Leahy chose to misrepresent Sotomayor's own words - leaving out that stuff about her capability in a court of law to reach "a better conclusion than the white male."

The exact Sonia Sotomayor quote, in a 2001 speech, and then in another 7 instances is:

I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life.

But if you were watching the Leahy-Sotomayor exchange, as was I and the Washington Examiner was, you noticed that Leahy specifically left out the racial and ethnic point of her comment. As the Washington Examiner said, "one way to lessen the impact of Sonia Sotomayor's "wise Latina" comment is to misquote it."

Sen. Patrick Leahy, D-Vt.: "You said that, quote, you would hope that a wise Latina woman with the richness of her experiences would reach wise decisions. ... So tell us, you've heard all of these charges and countercharges, the wise Latina and on and on. Here's your chance. You tell us — you tell us what's going on here, Judge."

Senator Jeff Session (R-AL) set the record straight when it was his turn at the microphone:

I would suggest that the quotation he [Leahy] gave was not exactly right of the wise Latina comment." Sessions then read the correct quote. It was only then that Sotomayor said her remark "fell flat" and "left an impression that I believed that life experiences commanded a result in a case, but that's clearly not what I do as a judge.

Of course, it is exactly what she meant. It was what she intended and it was exactly the impression that she hoped to leave with the audience on those occasions when she spoke the words. Sotomayor explained [paraphrased - but a very close paraphrase] that when she was speaking to women lawyers or young Latino lawyers or students, she intended to inspire them, to show that their life experiences could enrich the legal system, and that they should believe that they could become anything they wanted to become. So the question is, what does a white man's conclusions have to do with inspiring other women? The answer is that she intended to inspire them through encouragement that a Latino woman's conclusions are better than a white man's conclusions.

It is not difficult if you cut through the misrepresentations of Leahy's and Sotomayor's part, and then apply a slight bit of common sense. Jim Kouri at examiner.com has some interesting comments about Leahy, his warnings to the GOP and his legacy as "Leaky Leahy," when it comes to "top secret communications," (in other words - government secrets). It is worth reading, and being reminded who so many of these powerful Democrats are somewhere inside their shallow souls. Are you contacting your Senators?

Frank Ricci is Sotomayor Target: Frank Ricci the new Joe the Plumber

Frank Ricci is the New Haven, Connecticut firefighter who just had his reverse discrimination lawsuit upheld by the U.S. Supreme Court. The decision brought to light Obama's Supreme Court nominee, Sonia Sotomayor's decision against Ricci in a District Appeal Court ruling. The People for the American Way are stepping in to discredit Ricci. Don't you know they would?

The City of New Have paid $100,000 to a testing firm to come up with an exam "completely free of any racial bias." Ricci took a test for promotion along with other firefighters. Nineteen Whites and 1 Hispanic (considered White and Hispanic) passed the test but in the end, was denied promotion because no Blacks and only one Hispanic passed the exam. There were no promotions for anyone!

The city gave the test to 118 candidates, 27 of whom were black. None of the black candidates scored high enough to qualify for the 15 immediately available positions. All 20 of the plaintiffs qualified. After a series of raucous meetings, the city civil service board decided to scrap the test results and promote no one.

The firefighters filed a reverse discrimination case that was heard by the 2nd U.S. Circuit Court of Appeals, on which Sonia Sotomayor sat. Sotomayor and a majority of the Appeals court sided with the city of New Haven that the city had a valid concern that had the White firefighters been promoted, the city may have been sued for civil rights violations, by the Black firefighters who failed the test. The case made it's way to the Supremes and in June in a 5-4 vote, the Court overturned 2nd Circuit Court of Appeals. Judge Sotomayor's confirmation for the highest court in the land begins on Capitol Hill on Monday, July 13th. Ricci is expected to testify in front of the Judiciary Committee, on behalf of Republicans. People for the America Way, and reportedly other unnamed sources are "discreetly" urging "journalists" to look into Frank Ricci and his "litigious background." In 1995, Ricci filed a lawsuit against the city of New Haven for discrimination related to his dyslexia. Another story is making the rounds of Ricci being fired by a fire department in Middletown, Ct because Ricci reported safety concerns. That fire department was fined for safety violations but the lawsuit went nowhere.

With his awards for bravery, some 17 years of fire department service and history of overcoming dyslexia, Ricci has become a compelling human character in the Sotomayor confirmation drama. Senate Republicans have summoned him, along with Lt. Ben Vargas of the New Haven Fire Department, as two of their 14 witnesses next week.

For information about the test and the positions that went unfilled, read this. So what this boils down is a hit job on Frank Ricci. The Left plans to turn Frank Ricci into the new Joe the Plumber. You probably remember Joe Wurzelbacher, known as Joe the Plumber, asking the campaigning Senator Barack Obama "you are going to raise my taxes, arent' you?" In that moment, Mr. Wurzelbacher's life changed. With the camera rolling, he told Obama that he was a plumber and might be buying a company that would make $250,000+ a year. Obama told Joe that "spreading the wealth around" was a good thing. Blogs on the Left and the mainstream media had a field day. Accusations against Joe flew: he wasn't registered to vote, he was a liar and then Politico.com reported that Wurzelbacher had a lien against his property. From Michelle Malkin:

After Wurzelbacher told Katie Couric that Obama's rhetorical tap dance was “almost as good as Sammy Davis, Jr.,” the inevitable cries of “bigotry” followed. (There are now tens of thousands of hits on the Internet for “Joe the Plumber racist.”)
