ACORN Funding Ban Upheld by Court

The 2nd Circuit Court of Appeals reversed Judge Nina Gershon's resumption ruling of Congress' funding of ACORN. The 2nd Circuit ruled that banning government funds to ACORN was not a form of "punishment" and therefore was not an unconstitutional bill of attainder, as the organizations attorney's argued.

Darrell Issa

Congress originally shut-off the money spigot. ACORN sued Congress. Congress won. Gershon reversed the win, and here we are this week with the 2nd Circuit upholding the original ruiling. Rep. Darrell Issa (R-CA) has been the taxpayer's watchdog on this case. Here's his statement
In one, unified and bipartisan voice, the United States Congress and the president agreed that it was inappropriate to use taxpayer dollars to fund a partisan political organization, intentionally structured as a criminal enterprise that used the guise of charity to deceive the American people while betraying very people it claimed to help.
Hopefully, today's ruling by the Second Circuit Court of Appeals puts an end to ACORN's misguided belief that there exists some right to taxpayer dollars to fund their overtly criminal and partisan political agenda.
For it's part, ACORN is asking the court to reconsider.
We cannot let Congress act like judge, jury and executioner without any hearings at all. No matter how politically unpopular and vulnerable ACORN is, we cannot allow right wing to pressure Congress into acting in unconstitutional manner.
So when the spigot stopped, and Gershon turned it back on...does ACORN have to repay the taxpayer's money?

Anita Moncrief Acorn Whistle Blower Releases Obama Donor List - Files FEC Complaint

Anita Moncreif is a former ACORN worker, turned whistle-blower. She is filing a complaint with the Federal Election Commission (FEC) against the Obama campaign and their work with ACORN. She is also releasing the campaign's second quarter donor list, which, according to Moncreif, Obama refused to release. He gave the list to ACORN, who then reportedly used it to raise money. Obama says it is not his list and has denied the list to the New York Times, who refused to run the story. See the video below, filmed at the Las Vegas Right OnLine convention. Bill O'Reilly Rachel Maddow: O'Reilly to Maddow: Fox Kicks Your Networks Butt Every Single Day

O'Reilly's show on Thursday night revolved around the Shirley Sherrod story. Some other networks had a few things to say to about Fox News and Shirley Sherrod. Maddow made some odd statements, including saying the ACORN story [remember the pimp and prostitute] was "fake," and she wrapped it up with "Fox does what Fox does" to which O'Reilly answered "which is kick your network's butt every single day." Sorry, the video embed is not working. Please view it here.

Video: Witness the Community Organizers in Action!

Witness community organizers at work. We've heard about how these groups have shaken down banks for decades in order to get the banks to issue risky loans. Here they are, caught on video, storming a bank at the exact moment President Obama signed his disastrous Wall Street bill.

Big Government reported:

The scene was mayhem as forty protestors, including several children brought in tow, stormed into the offices of the Chase branch and began chanting, shouting with a bullhorn, and demanding meetings with the bank principals (there were no principals, as it was a sales branch), but that didn’t matter to protestors.

The group was professionally organized by former Missouri ACORN Midwest director Jeff Ordower, in addition to Hannah Allison, the paid organizer for Missourians Organizing for Reform and Empowerment, the newly branded spawn of the Missouri ACORN employees. The group had everything set up. The protestors get inside the building, disrupt the operations, ignore the complaints of office staff, and continue until the police arrive. At that point, the two white organizers negotiate with the police, while the mainly black crowd goes out to the lobby. As more police and building security arrive, the group heads outside, where the organizers speak in measured tones to the compliant local media.
After the bank agreed to renegotiate the terms of a mortgage the group quietly left the scene.

Can you imagine going about your regular business at your local bank and encountering this scene? But we won't hear anything about these thugs from Pravda the mainstream media or Journolist.

Nevada ACORN: Nevada Takes ACORN to Court for Voter Fraud

Nevada's Democrat Attorney General, Catherine Cortez Masto, will see ACORN in court on November 29th. The somewhat defunct, but not entirely defunct ACORN is charged with voter registration fraud and allegedly giving ACORN employees quotas for the numbers of voters to sign-up.

Catherine Cortez Masto

ACORN Las Vegas Field Director, Christopher Edwards is charged with election fraud. He has pled guilty to two counts of conspiracy for compensating others for the registration of voters, and has cut a deal with the state. Edwards will reportedly testify against former ACORN Regional Director, Amy Busefink, and ACORN, which is a co-defendant in the case.
The Las Vegas Sun reported that Edwards acknowledged he conspired with Busefink and ACORN to create the "Blackjack" incentive program that gave canvassers an extra $5 for submitting 21 or more registration cards each day. The daily quota was allegedly 20 forms.
If convicted, ACORN stands to lose their nonprofit corporation status revoked.
Such a conviction would send shock waves through leftist organizing circles across the nation and might embolden more prosecutors to take on ACORN. Until it was charged by Nevada this year, ACORN had boasted about its ability to duck prosecution for election fraud.
After an amazing collection of videos revealed ACORN's most intimate dirty linen, Congress defunded the group, and they supposedly shut their doors, and dissolved into other similar groups around the country. ACORN and its election fraud subsidiary Project Vote, which used to employ President Obama, registers “Mickey Mouse” and various celebrities, out-of-state residents, and dead people, every election cycle. Conrad Hafen, chief deputy state attorney general, was quoted in a news report saying neither bankruptcy nor dissolution would “necessarily protect (ACORN) from prosecution” in Nevada.

I don't know anything about Masto, but I applaude her, a Democrat, who is doing the right thing and saying "you will not come to my state and commit voter fraud on the residents of Nevada. Two thumbs up for Catherine Cortez Masto.

American Federation of Teachers Unions Hires ACORN

There is never enough money for our schools, in any school district anywhere in the U.S., and hasn't been for at least 45 years. One reason might be the way unions spend, and spend and spend. For example, The American Federation of Teachers funded ACORN after the 'pimp and prostitute' videos hit, when there was not a smidgeon of doubt about the non-existent integrity of Obama's favorite community organizers, the egregious and corrupt ACORN.

American Federation of Teachers Unions

A question would be, why would any Teacher's Unions, and especially the NEA, want to support an organization that helped a pimp and a prostitute with their plan to smuggle 13-year-old foreign girls into the country for prostitution, and hide the income they would make from the IRS.

Read the whole story at NetRightNation:
A good starting point would be with the $352,510 The American Federation of Teachers (AFT) funneled to ACORN in 2009 just as the organization's employees were caught on videotape describing to uncover investigators how they can arrange for legal loans, set up brothels, advance child prostitution and human trafficking.
"It looks like the AFT essentially outsourced ACORN to do the union organizing work," Nathan Mehrens, a counsel to Americans for Limited Government (ALG). "This is incredibly ironic given that many unions consider outsourcing evil and almost criminal. It might also be worth asking a rhetorical question of why does the union need to outsource work to shady operatives? If the union's services were so desirable then the teachers would be beating a path to their door and not the other way around."

AFT Chicago Protests Privatization of Schools in Detroit and St. Louis
In fact, U.S. Labor Department financial disclosure forms show that the teachers unions as whole have contributed over $1.3 million to ACORN and its affiliates for political activities and representational activities, since 2005. Some of the larger donations include $100,000 from the National Education Association in 2008 and $200,000 in 2007 for political activities. The Teachers AFL-CIO Local Union 2 contributed $406,730 in 2008, $457,778 in 2007, and $346,300 in 2006 for representational activities.

Acorn Funding Ban Reinstated: Gershon Order Stayed: No Money for Acorn

The U.S. Court of Appeals Second Circuit has temporarily overridden Judge Nina Gershon's order to reinstate Congressional funding of ACORN. After ACORN was outed in the "Pimp and "Prostitute undercover stories, Congress defunded the organization, which was shown to be willing to provide advice on how the "pimp and the prostitute," visiting numerous ACORN offices across the United States, could hide income from the IRS in an operation to smuggle 13-year-old girls into the country for prostitution.

 Darrell Issa

After Congress yanked their funds, ACORN sued. Gershon reinstated the money machine, and our tax money began flowing to this outrageous organization again. The Second Circuit Court of Appeals will now further review the case, but the money will be stopped immediately (whatever "immediately" means in Congress).

Today, Rep. Darrell Issa, the ranking member of the Committee on Oversight and Government Reform and Judiciary Committee Member announced that the funding has once more been stopped -- but temorarily.
"I applaud the Court of Appeals for immediately addressing the effects of judge Gershon's attempt to legislate from the bench. Today's action immediately restores the congressionally mandated ban on funding ACORN and its affiliates as a result of their criminal conduct and wasting of taxpayer dollars. Congress has the constitutional right to deny an organization the benefit of taxpayer dollars.

With today's action by the Appeals Court, the Obama Administration must take immediate steps to re-implement the funding ban for ACORN Congress put in to law. In recent months, ACORN has undergone a rebranding campaign to disguise itself and its affiliates. As a result, the White House and all federal agencies must be extremely vigilant to ensure that rebranded organizations who have continued to make deals and maintain connections to ACORN don't receive taxpayer dollars."

Bertha Lewis' New Acorns Won't Fall Far from the Tree

All ACORN offices will be closed as of April 1, 2010, but will rise again from their ashes in the form of numerous small, multi-named organizations across the map. The challenge will be to find the new ACORNs, and watch them like a hawk as we go forward to the November 2010 elections. These people, like a particularly foul stench, never go away. ACORN CEO Bertha Lewis will likely run the new organizations, most of which are not new -  cobbled together under her wing and still an angry beast.

Bertha Lewis

Lewis, who replaced ACORN founder and CEO Wayne Rathke after a financial scandal,  is a co-founder of the Working Families Party, which is still under investigation by the Federal government for election finance law abuses and voter fraud.

After BigGovernment's reveal of ACORN's willingness to turn a blind eye to an operation of 13-year-old-Salvadoran girls, smuggled into this country for prostitution, and cogent advice on how the business could hide income, Bertha Lewis was forced to acknowledge some of the organization's weaknesses, which resulted because of "the problems of being poor and minority in urban America." Kathryn Jean Lopez wrote this about Lewis' statement:
And herein lies the deeper scandal -- it's not just the denial of what is right in front of your face, it's denial of a bod mode of operating, of a sickness in policy and philosophy. For as much as the Right is attached for being dismissive of the poor and most vulnerable, the Left clutches that which continues the plight of government dependence among so many.
Trying to discern where ACORN-by-another-name lives, will be the equivalent of catching a handful of air for awhile. As we approach the elections, we should find the "workers" standing on every street corner. We need to follow them back to the paymaster at the end of each day. Where the money is, still funded by American taxpayers, you'll find the stench the foulest.

Acorn Funding Restored: Acorn Funding Slips under the Radar

Peter Orszag, Obama's director of Office of Management and Budget (OMB) ordered resumed funding  for ACORN. With recent news that ACORN, a community organizing group that Barack Obama once worked for has gone underground, changed their tainted name...and somehow is back in the saddle with taxpayer monies.

After several ACORN offices across the U.S. were videotaped giving advice on how to avoid paying business taxes and how to hide the fact that the business was prostitution of 13-year-old girls smuggled into the U.S., Congress cut off funding.

ACORN took it to court and won a temporary injunction by Judge Nina Gershon, which has now turned into a permanent injunction.

ACORN has been charged with election fraud in Nevada. Two ACORN workers in Wisconsin are charged with election fraud. Ohio has filed a RICO suit against ACORN. Read here about ACORN's fraudulent voter registrations. Read Gateway Pundit for Obama's past association with ACORN. Read BigGovernment for a link to Orszag's letter directing the spigot open, and asks why the DOJ cannot achieve a stay in this case until the appeal is concluded.

Acorn Drops Lawsuit against O'Keefe and Giles

ACORN dropped their multi-million dollar lawsuit against James O'Keefe and Hannah Giles, who entered several ACORN facilities across the map, and recorded ACORN employees giving advice on how to evade tax laws and keep a prostitution business offering 13-year-old, smuggled Salvadorean girls under the radar. The suit was dropped because ACORN failed to serve O'Keefe, Giles and Andrew Breitbart's Breitbart.com. Perhaps the plan was never to serve the defendents knowing you can't defend the indefensible.

Hannah Giles and James O'Keefe

Copyrights and Campaigns has the court docket showing a failure to serve. The case was filed in Baltimore based on Maryland law saying that all persons being recorded or videotaped must give consent to the action, but the content of the tapes demonstrated a flagrant disregard for tax law, human smuggling, prostitution and more.

Ben Sheffner at Copyrights and Campaigns predicted in September 2009 that the lawsuit would fail because first, there must be a reasonable expectation to privacy, which would be a difficult case to make in an office where doors were open, and children could be heard in the area.

So while ACORN received enormous publicity over the lawsuit, they have also been under enormous scrutiny since the tapes surfaced; so much so that they are attempting to change their name, closing offices for lack of funding and finding it more and more difficult to find anyone sympathizing with their supposed mission of registering the poor and disenfranchised to vote. See the background at BigGovernment.com.

Acorn Brooklyn Cleared in Pimp Prostitute Undercover Tapes

A five-month investigation into a tape showing Brooklyn's ACORN office giving advice to a pimp and a prostitute has been cleared of any wrong doing. The tape shows ACORN employees providing information on how to smuggle 13-year-old foreign girls into the country, put them in a house of prostitution and avoid paying taxes on profits. See videos below.

 Hannah Giles and James O'Keefe

The prosecutor, Brooklyn DA Charles Hynes, is a member of SEIU's Working Families Party and is closely tied to ACORN. Apparently, the investigation ended because the prosecution said the two people posing as the pimp and prostitute, Hannah Giles and James O'Keefe, edited their video - rendering it "unclear" what the ACORN workers said or did not say.

I'd like to see the unedited version, and I bet you would too. I'd also like to hear just where the stories don't quit gel. Do you think we'll hear where there was insufficient clarity was apparent.

Founding Bloggers makes the point that Hynes is a member of the Working Families Party, by virtue of a pledge he signed, and an endorsement he received. "You have to seek the endorsement and make a commitment to the party."

The whole thing stinks on ice.

In the Giles and O'Keefe undercover tape in a San Diego ACORN office, ACORN spokesman, David Lagstein allegedly told members of the East County Democrat Club that Attorney General Jerry Brown plans to find fault with the videographers (Giles and O'Keefe). Follow the link and hear the audio.

BigGovernment says California governer Jerry Brown will have a tough time going after Giles and O'Keefe for illegally taping the ACORN employees, as his aides "secretly recorded phone conversations with at least 5 reporters.

Let's hear what is "unclear" in the Brooklyn tapes. Watch the videos below and let me know if you think they could have been edited to show a result that clearly was not a part of the tapes. Also, see links to other videos of other ACORN offices around the country.

Republicans go After ACORN...Again: ACORN SEIU Intertwined

A new U.S. House report adds fresh fodder to the already existing documents incriminating ACORN for "thousands of fraudulent voter registrations" across the U.S.. It ties ACORN and SEIU - substantially intertwined and joined at the hip. It shows conclusively that ACORN's part in the housing meltdown was instrumental in thousands losing their home, but by design, infamously lucrative for ACORN. You'll notice Project Vote is mentioned in the House Committee report. See a video about Barack Obama and Project Vote below.

Obama Teaching Project Vote

In September 2009, Rep. Darrell Issa (R-AC) and Rep. Lynn Westmoreland (R-GA) announced a bill to deny federal funding to ACORN corruption. The legislation passed, ACORN sued in Federal District Court and won an injunction against the U.S. Government until the case is heard. According to the report dated February 18, 2010, you and I were forced to rush to the aid of this corrupt bunch - as a check was cut for funding already underway:
According to the Louisiana Department of Justice, ACORN is nearing financial bankruptcy, as most of its donors have cut ties with the corporation. However, under Judge Gershon’s decision, ACORN will continue to receive taxpayer dollars from the Federal Government. In other words, the American people will have BAILED OUT ACORN.
But now, a new round of fresh documents released by the House Oversight and Government Reform Committee, is renewing the fight against the Democrats strongest allies on the streets of America - ACORN operatives.

The Republicans' latest report contains documents that they say confirms previous findings that ACORN is responsible for thousands of fraudulent voter registrations across the country and has used taxpayer money to support a partisan political agenda.
"Committee investigators have identified hundreds of ACORN bank accounts, shell organizations incorporated under different sections of the Internal Revenue code, and even an ACORN controlled accounting firm (Citizens Consulting Inc.) that helps ACORN obscure the true use of charitable donations and taxpayer funds," reads the report, titled "Follow the Money: ACORN, SEIU and their Political Allies."
"Documents and testimony from ACORN whistleblowers reveal that ACORN activities -- despite contentions that they are intended to help the poor -- fulfill a more self-serving and political purpose for ACORN."
The first report in the the summer of 2009 explained the following:
...how ACORN used a complex organizational structure of overlapping nonprofit community initiatives and political lobbying activities to conceal the partisan political use of taxpayer and private monies originally designated for the public benefit. The report found there was no real separation between ACORN and its affiliates. ACORN is a single corrupt corporate enterprise composed of a series of holding companies and subsidiaries that are financially and operationally dependent upon the main corporation.
The new report "Follow the Money: ACORN, SEIU and their Political Allies" adds new evidence confirming the previous finds, as well as a "closer examination of ACORN's financial transactions and fundraising that shows the organization to be a "political machine."
Committee investigators have identified hundreds of ACORN bank accounts, shell organizations incorporated under different sections of the internal revenue code, and even an ACORN controlled accounting firm (Citizens Consulting Inc.) that helps ACORN obscure the true use of charitable donations and taxpayer funds. Documents and testimony from ACORN whistleblowers reveal that ACORN activities – despite contentions that they are intended to help the poor – fulfill a more self-serving and political purpose for ACORN. ACORN is well aware of the legal problems its political activities create as its own attorneys have acknowledged and outlined the potential for criminal and civil violations in private documents for senior ACORN officials.
Since release of the first report, Committee staff met with insiders from both ACORN and the Service Employees International Union (“SEIU”) in addition to obtaining and reviewing documents from virtually every state, including California, Missouri and Oklahoma.
The new report makes four crucial findings:

1) Criminal conspiracy - names ACORN CEO Bertha Lewis, Executive Director Steven Kest, and Political Operation Director Zach Polett.

2) Pattern of corruption common to all ACORN affiliates called "Muscle for the Money," or or using non-profit corporations for electioneering activities; strategies to threaten corporations and banks into brokering deals for ACORN's financial benefit - thus the "muscle."
SEIU and Project Vote [see video below] used litigation to force demands from government officials. ACORN, through Project Vote, threatened State Secretary of State offices with lawsuits, thus forcing political compromises at the expense of taxpayers.
This charge makes it clear that SEIU and ACORN "are substantially intertwined - ACORN taking the lead, sEIU the willing accomplice, and both allegedly engaged in fraudulent activities. ACORN has received $5.6M from SEIU, and according to this report, despite SEIU's objections, they have "never cut ties to ACORN.

3) The ACORN corporation is responsible for thousands of fraudulent voter registrations throughout the U.S.
Responses from various state election offices show that ACORN’s late filings of voter registration cards and the sheer amount of fraudulent cards obstructed election administration efforts in many states. Fraudulent voter registrations are not isolated incidents; they reflect ACORN’s criminal motive to compromise the system of free and fair elections promised in the Constitution of the United States.
4) ACORN contributed to the risky lending that led to the financial collapse. The following is the story of the infamous Community Reinvestment Act. Reps. Barney Frank, Maxine Waters and Senator Chris Dodd should be behind bars:
ACORN drafted language to loosen underwriting standards and decrease down payments in the housing industry, paving the way for the high rate of subprime loans millions of Americans eventually defaulted on.
ACORN used provisions in the Community Reinvestment Act of 1977 that allowed community groups to challenge bank mergers and acquisitions if a bank did not adequately invest in its own community. These challenges, which featured ACORN's standard intimidation tactics, successfully forced banks to make lending agreements with ACORN Housing. If banks refused ACORN’s demands, they jeopardized approval of mergers in a timely manner. ACORN Housing moved to become a conventional service provider for the loans. ACORN reaped profits from over a billion dollars in loans to low- income neighborhoods. Because of the policies and financial instruments developed, in part through ACORN’s lobbying activities, borrowers eventually defaulted on the loans. The end result was the bursting of the housing bubble.
ACORN Housing received a total of $39,925,620.13 from Bank of America, JPMorgan Chase & Co., CitiBank, HSBC, CapitalOne, and SunTrust. These lenders and banks also provided ACORN with grants, address and bank account information of at-risk homeowners so ACORN could provide free counseling services. Instead, ACORN used the address and bank account information to target struggling Americans who would be signed up as dues-paying members of ACORN. ACORN’s membership recruiting brought in $48 million a year for ACORN—a boon for their Muscle for Money program.

Patrick Covington Confirmed to CNCS: Covington and CNCS ACORN Funders

The Senate's latest confirmation is that of Patrick Covington to the CEO of the Corporation for National and Community Service (CNCS). In his previous position at the Annie E. Casey Foundation, Covington was instrumental in funnelling huge sums to ACORN.

Patrick Covington

In fact, The Annie E. Casey Foundation and Patrick Covington directed $1.7 million to ACORN, $800,000+ of it to the Baltimore office where James O'Keefe and Hanna Giles went undercover as pimp and prostitute to expose the organization's illegal activities. O'Keefe and Giles sought advice on hiding income from the IRS while they set up a house of prostitution for 13-year-old girls smuggled in from outside the U.S. If you have not seen the video, click the link and take a look. You won't believe what you will see and hear.

About the Annie E. Casey Foundation:
The Casey Foundation favors the presence of a large, centralized government exercising control over the health care services, employment, and personal incomes of American citizens. To influence policymakers, program administrators, the news media, and other audiences in supporting innovations it regards as progressive,...
According to Discover the Networks, the Annie E. Casey Foundation is deeply involved with "racial injustice," specifically directed at youthful offenders. Of course, you and I would want to know if the youthful offenders, actually "offended," no matter their race - but not the Annie E. Casey Foundation - or the current administration, for that matter.

Annie E. Casey provides funds to the Tides Agency, which is believed to funnel funds to ACORN, although they deny it. LibertyChick has some comprehensive background on The Tides Foundation, SEIU, ACORN and Wade Rathke. They are all swarming the same hornet's nest.

Among the Casey Foundation's hundreds of grantees are the Brookings Institute, the Arab american Institute Foundation, ACLU, LaRava, Save Middle East Action Committee, and of course, ACORN.

You may remember Inspector General Gerald Walpin, who worked through CNCS. He exposed $75 million in misused funds to ACORN, and then was fired by the White House. He also exposed former NBA Star and current mayor of Sacramento, and his access to ACORN monies, through the same CNCS office. See links to information on IG Walpin's work and firing below.

Gerald Walpin was completely cleared of any abuse of authortity as an Inspector General and is suing to get his job back.

Democrats will not let go of ACORN. Doesn't matter how outrageously illegal ACORN is. Doesn't matter that they promote voter fraud. Democrats keep shoving them at us. As Zell Miller famously said: They have no shame.

James O'Keefe Arrested: ACORN Buster O'Keefe

James O'Keefe, one-half of the famous prostitute and pimp duo, who exposed ACORN for fraud and illegal services at numerous ACORN offices around the country last summer, has been arrested for allegedly, "maliciously" interfering with the telephones in Senator Mary Landrieu's New Orleans office.

O'Keefe was arrested along with Robert Flanagan, the son of acting U.S. Attorney Bill Flanagan, Joseph Basel, and Stan Dai, each 24-years-old.

You'll remember that Andrew Breitbart and BigGovernment broke the ACORN story. Breitbart issued the following statement today:

“We have no knowledge about or connection to any alleged acts and events involving James O’Keefe at Senator Mary Landrieu’s office.  We only just learned about the alleged incident this afternoon.  We have no information other than what has been reported publicly by the press.  Accordingly, we simply are not in a position to make any further comment.”
An FBI arrest affidavit says the men, on or about January 25th:
...entered and attempted to gain entrance to the office and telephone system of the United Sates Senator Mary Landrieu, located in the Hale Boggs federal Building, Room 1005, 500 Poydras Street, New Orleans, Louisiana 70130.
Dai is said to have "aided and abetted" Flanagan and Basel in the execution of the plan." A witness said James O'Keefe was already in the Senator's office when Flanagan and Basel showed up, and told Witness 1 "he was waiting for someone to arrive."

According to Witness 1, Flanagan and Basel said they were there to "fix problems with the telephone system," and she believed O'Keefe was taping the conversation with his cell phone.

Flanagan and Basel allegedly asked for entry to the main phone system. They told a second witness they needed to access the main phone system. Witness 2asked for credentials, which they said they left in their vehicle. The affidavit states that neither of the men are employed by the telephone company.

O'Keefe and Dai have also admitted to federal agents that they worked with Flanagan and Basel in the planning, coordination, and preparation of the operation." O'Keefe admitted to recording some of the conversation.

The affidavit states there is "probable cause" to believe there was "false and fraudulent pretense" to enter the Landrieu's office, and "maliciously interfering with a telephone system operated and controlled by the US of America," a violation of Title 18, US Code, Sections 1036, 1362 and 2." Democrats Suicide Strategy - Do They Know Something We Don't?

Much has been made about how Democrats are committing political suicide with the healthcare bill and all the other onerous legislation they have proposed and/or passed this year. There is no mistaking that these actions are extremely unpopular. The widespread uncertainty they have fostered in the business community by coupling job-killing legislation and talk of big tax increases with unprecedented, reckless deficit spending has kept our economy at a virtual standstill. And their insulting, arrogant, dishonest and blatantly corrupt behavior has brought citizen concern and anger to a fever pitch, while Democrat poll numbers plummet.

But those who believe in this "Democrat suicide" model implicitly assume next November's elections will be free and fair. Given ACORN’s antics, Democrat Secretaries of State literally stealing elections, shocking abuses of power by Democrats in Congress and the administration, the blatant thuggery of SEIU and other union activists, while the media covers for them, such an assumption is fairy tale fantasy. It would be funny to think some people actually have that much faith in Democrats, if the implications weren't so disastrous. As it is, one can only cry. Read more...

Nina Gershon Acorn: Gershon Rules Congress Impotent: Michele Bachmann Barney Frank:

Judge Nina Gershon ruled that ACORN will continue to receive millions from American taxpayers, effectively ruling Congress impotent to take away what they giveth; and Rep. Michele Bachmann (R-MN) discusses Rep. Barney Frank's (D-MASS) amendment in the House Financial Services Committee to allow ACORN a seat on the panel that monitors the Financial Services Committee regulations. See a video below.

Congress banned federal payments to ACORN (Association of Community Organizations for Reform Now) after video surfaced of ACORN advising clients how to avoid federal taxes on illegal businesses, purchase a house to be used for prostitution and trafficking foreign 13-year-old girls for prostitution. The ruling renders Congress even more impotent than already shown to be in this era of Obama Czars.

Congress can give, but apparently Congress cannot take away, once you are on the federal Philanthropic gravy train.

From The Hill:

Judge Nina Gershon concluded that the ban amounted to a "bill of attainder" that unfairly singled out ACORN.
"[The plaintiffs] have been singled out by Congress for punishment that directly and immediately affects their ability to continue to obtain federal funding, in the absence of any judicial, or even administrative, process of adjudicating guilt," Gershon wrote in her decision.

Gershon said ACORN had demonstrated "irreperable harm" from the ban, while "the potential harm to the government, in granting the injunction, is less."

"The public will not suffer harm by allowing the plaintiffs to continue work on contracts duly awarded by federal agencies, which was stopped solely by reason of [the ban]," Gershon wrote.

Rep. Darrell Issa (R-CA), the ranking Republican on the House Oversight and Government Reform Committee said the following about Clinton-appointed Judge Gershon:
This left-wing activist Judge is setting a dangerous precedent that left-wing political organizations plagued by criminal accusations have a constitutional entitlement to taxpayer dollars," Issa said. "The Obama Administration should immediately move to appeal this injunction.”
A couple of questions:

(1) will we now see organizations not receiving federal funds, or not receiving sufficient federal funds, also suing Congress to get on the gravy train? How can we have one without the other? and

(2) can "we the people" sue Congress for using our money for fraudulent purposes (which can go far beyond just ACORN)?

Bachmann talks about both of these issues in the excellent video below. Here is a portion of her comments:
ACORN, a criminally corrupt organization, that was recently caught on videotape, counseling a pimp and a prostitute, who wanted to bring underage illegal aliens into the U.S....counseling them on how they could purchase a house of prostitution, to further prostitution of underage illegal aliens. That's about as bad as it gets, so now Barney Frank wants to create a slot, a seat on the oversight board of our financial services industry in America, and give ACORN a seat? This is beyond outrage and this shows how out of touch not only Chairman Frank is, but how out of touch this Congress is, and for any members of this Congress to vote for Chairman Frank's financial services bill, knowing that ACORN will have a seat at the board of directors, overseeing all of financial services, it is time to be serious time, be serious, and I just think it would be reprehensible for Congress to cast that vote.
You and I have been "serious" for a long time now, about the fraud inside the halls of Congress. Frank should lose his seat just for entertaining the amendment. It is a hard pill to swallow to believe that his constitutients want this graft and corruption in the name of governance, coming from their districts.

Holder to allow ACORN funding, despite ban

Current law prohibits the community organization ACORN and its associated groups from receiving any federal funds from any federal law currently on the books, (P.L 111-68 Sec. 163). However, the Eric Holder Justice Department has interpreted the law's phraseology in such a way that permits federal agencies to pay ACORN for "binding contractual obligations" the government made before the current prohibition was enacted. This interpretation may go a long way toward effectively neutralizing ACORN's funding prohibition, and it is a questionable interpretation at best. The actual ban reads as follows:

None of the funds made available from this joint resolution or any other prior Act may be provided to the Association of Community Organizations for Reform Now (ACORN), or any of its affiliates, subsidiaries or allied organizations.
(Emphasis added.) The Justice Department has decided that the phrase "provided to" is unclear and "has no established meaning in appropriations law." They cite terms more frequently used, such as "obligate" and "expend," that have widely accepted meaning in spending legislation. They go on to arduously defend their point by exhaustively listing the many definitions of "provide" given in Websters, Oxford and American Heritage dictionaries and even Roget's Thesaurus. Like Bill Clinton, they probably could have found as many definitions for the word "is..." Read more... Related: Holder Clears ACORN for Payment: Darrell Issa Objects

Jerry Brown ACORN: ACORN Brown Document Dump:

California Attorney General, Jerry Brown, was interviewed by KABC's Peter Tilden about thousands of documents found in a trash dumpster outside the San Diego ACORN office. Once again, Brown seems to be protecting ACORN in the latest scandal - a garbage can document dump.

Jerry Brown

In this case, an "investigator" saw someone from an ACORN office dump "things" into an outdoor dumpster. The investigator took a look and found twenty-thousand documents with personal information about, presumably, ACORN clients who filled out paperwork with personal information like social security numbers, addresses, phone numbers and perhaps banking information. No care was taken by ACORN to block out the sensitive material by disposing of it.
ACORN's political agenda is also exposed, with thousands upon thousands of documents revealing the depth of the political machine that is ACORN, and its disturbing ties to not only public employee labor unions but some of the most radical leftist organizations.

The laws governing how sensitive, personal information such as social security numbers, driver's license numbers, immigration records, tax returns, etc. must be treated are very stringent, and thus it seems as if ACORN may have committed serious violations in that department alone, with thousands upon thousands of potential plaintiffs.
ACORN may fall into a category of lenders and tax advisers which is federally regulated by how a client's private information can be disposed of. Your bank cannot simply put your private information in a trash bin. Can ACORN? But Brown believes we have an "expectation" of privacy in our trash bins? ACORN may, but you can bet, you and I do not have that same "expectation." The other side of this story is that Jerry Brown supposedly has an investigation underway into ACORN, and so we might think he would be a tad upset that the office is dumping documents of any kind.

We would be wrong with that assumption. Jerry Brown has some major fondness for ACORN.  Recently, David Lagstein, the "chief" organizer for San Diego's ACORN office, was caught on tape saying that Jerry Brown had just called for an investigation into ACORN, specifically prompted by the famous "pimp and prostitute" tapes recently exposed by BigGovernment.com. Lagstein is heard, and recorded, saying that Brown's office "suggested that the fault will be found with the people that did the video and not the people with ACORN."

But the investigator is the one being scrutinized. Who is he working for...who paid him? Listen to the audio of Brown and the Tilden Show. Brown almost immediately quotes a poll saying 52% of Republicans believe that ACORN actually stole the election for President Obama." He rambles and his behavior is bizarre - but he promises an unbiased investigation! Notice there are no questions about David Lagstein's claims that the fix is already in on the pimp and prostitute investigation.

Holder Clears Acorn for Payment: Darrell Issa Objects

What a slap in the face of taxpayers. The Justice Department has just directed payments be made to ACORN for costs incurred before they were caught trying to help a pimp and a prostitute set up an illegal smuggling operation of 13-year-old-girls brought to the U.S. for prostitution. Rep. Darrell Issa (R-CA) is objecting to the DOJ's decision. Perhaps Congress can get over the turkey and stuffing and do something about the DOJ's latest in a long list of obscenities.

 Darrell Issa

Issa's statement at the bottom of this article accuses the administration of "a payback" to one of Obama's political allies and says this latest move is "nothing more than old-fashioned cronyism."

In this piece in the New York Times "reports," if that's what we can call it it, that ACORN has become a "target" of "conservative critics." Obama was forced to sign legislation saying that no taxpayer monies would be provided to ACORN or it's affiliates. Later in the article, the NYTs explains that the pimp and prostitute sought financial advice, but did not mention that the business involved 13-year-old girls, illegally smuggled for the purpose of prostitution.

An attorney for the Housing and Urban Development Department (HUD) queried the DOJ "whether the new law meant that pre-existing contracts with ACORN should be broken." Since 1994, ACORN has received approximately $53 million of your hard-earned money and mine - most of it in grants from HUD.

The acting assistant attorney general for the Office of Legal Counsel, David Barron, wrote a five-page memorandum addressing the question. Here's the bottom line of that memo:
We conclude, in agreement with the views we solicited and received, that the language of section 163 [the ban on payments to ACORN] is not clear with respect to whether its prohibition applies in cases where pre-existing law apart from section 163, including the contract itself, compels such a payment and where, accordingly, failure to make such a payment would subject the federal Government to contractual liability.  In accord with established interpretive principles for resolving such lack of clarity, we conclude that section 163 does not direct or authorize HUD to refuse payment on binding contractual obligations that predate the Continuing
Appropriations Resolution.
Then there is this government gibberish:
Section 163 states, “None of the funds made available by this joint resolution or any prior Act may be provided to the Association of Community Organizations for Reform Now (ACORN), or any of its affiliates, subsidiaries, or allied organizations.”  The term “provided to” has no established meaning in appropriations law.  As explained by the GAO Redbook, “[t]he two basic authorities conferred by an appropriation law are the authority to incur obligations and the authority to make expenditures.  An obligation results from some action that creates a liability or definite commitment on the part of the government to make an expenditure. . . . The expenditure is the disbursement of funds to pay the obligation.” ...

By contrast, as we have noted, the term Congress elected to employ in section 163, “provided to,” has no clearly defined meaning in appropriations law.  See, e.g., GAO Glossary (containing no definition of “provision” or “provide”).  Moreover, appropriations case law and reference materials we have consulted, including the GAO Redbook, do not shed light on whether “provided to” in section 163 should be understood to prohibit a federal agency from making payments to satisfy pre-existing contractual obligations...
This is what we pay the Department of Justice to do on our behalf - to go to the American Heritage Dictionary to define the words "supply," "furnish," and "provide:"
To be sure, some common definitions of “provide,” such as “supply” or “furnish,” American Heritage Dictionary 1411 (4th ed. 2006), would appear to describe any transfer of funds, presumably including a transfer in satisfaction of an existing obligation.  Other definitions, however, connote a discretionary action.  For instance, “provide” may mean “contribute,” Webster’s New International Dictionary 1994 (2d ed. 1958), or “make available,” American Heritage Dictionary 1411 (4th ed. 2006), and “offer” is among its synonyms, Roget’s II: The New Thesaurus 780 (3d ed. 1995).
And in common parlance, the verb “provide” frequently describes discretionary action taken to benefit another. Moreover, several of the word’s definitions incorporate a forward-looking aspect, see, e.g., Webster’s New International Dictionary 1994 (2d ed. 1958) (“to look out for in advance”; “to prepare”); Black’s Law Dictionary 1224 (6th ed. 1990) (“[t]o make, procure, or furnish for future use, prepare”), consistent with the etymology of “provide,” which derives from the Latin providere, meaning to see before, foresee, or be cautious, 12 Oxford English Dictionary 713 (2d ed. 1989).  Definitions of the word “expend,” we note, do not carry a similarly discretionary or forward-looking connotation, in keeping with the etymology of that word, which comes from the Latin expendere, meaning simply to pay or weigh.  5 id. at 561.
But in the end, Mr. Barron's conclusion is that Congress had the proper language at their disposal to stop payments to ACORN for contractual agreements prior to legislation banning additional government funds, and chose not to use that language. After looking at court cases that Barron saw as other "interpretative tools:" Cherokee Nation of Oklahoma v. Leavitt, Lynch v. United States, and United States v. Winstar Corp., Barron concludes:
Reading section 163 to prohibit payments to ACORN or its affiliates, subsidiaries, or allied organizations to satisfy a binding contractual obligation undertaken before enactment of section 163 would “undo a binding governmental contractual promise.”  Cherokee Nation, 543 U.S. at 646.  In accord with Cherokee Nation, the better reading of the section is therefore that it does not prohibit such payments.  This reading of “provided to” is especially appropriate here because, consistent with the canon of constitutional avoidance, see, e.g., Edward J. DeBartolo Corp. v. Fla. Gulf Coast Bldg. & Constr. Trades Council, 483 U.S. 568, 575 (1988), it not only avoids abrogating binding governmental contractual promises but also avoids the particular constitutional concerns that may be presented by reading the statute, which applies to specific named entities, to abrogate such contracts, including even in cases where performance has already been completed but payment has not been rendered.
In sum, section 163 should not be read as directing or authorizing HUD to breach
a pre-existing binding contractual obligation to make payments to ACORN or its
affiliates, subsidiaries, or allied organizations where doing so would give rise to
contractual liability.
This from Rep. Issa, the ranking minority member on the House Committee on Oversight and Government Reform:
"the bipartisan intent of Congress was clear -- no more federal dollars should flow to ACORN."

"It is telling that this administration continues to look for every excuse possible to circumvent the intent of Congress," Issa said in a statement. "Taxpayers should not have to continue subsidizing a criminal enterprise that helped Barack Obama get elected president. The politicization of the Justice Department to payback one of the president’s political allies is shameful and amounts to nothing more than old-fashioned cronyism."

ACORN is already suing the government over the ban on funds:
The Constitution prohibits “bills of attainder” — legislation intended to punish specific people or groups. Acorn has filed a lawsuit arguing that the statute banning the government from providing it money amounts to a bill of attainder.
If ACORN can sue the government, then taxpayers surely must sue the government for giving this incredibly corrupt organization funds for all these many years. How long will we let this go on?
